Terms and Conditions: Van Wyk Vendors

1. General Overview

By purchasing or receiving a meal kit (raw or cooked) from Van Wyk Vendors, the Customer agrees to be bound by these Terms and Conditions. These terms govern the sale, delivery, and consumption of all food products.

2. Product Quality & Cold Chain Management

Van Wyk Vendors is committed to providing high-quality ingredients. However, food quality is highly dependent on environmental factors:

  • Cold Chain Maintenance: All perishable items are dispatched in temperature-controlled packaging. It is the sole responsibility of the Customer to ensure that products are refrigerated or frozen immediately upon delivery.

  • Storage: Raw proteins must be stored at or below 5°C. Cooked meals must be reheated to an internal temperature of at least 75°C before consumption.

  • Environmental Factors: Van Wyk Vendors is not liable for product degradation caused by delays in the Customer receiving the package, exposure to direct sunlight after delivery, or improper storage.

3. Allergens and Dietary Information

While we take precautions to avoid cross-contamination, our kits are prepared in facilities that handle nuts, shellfish, dairy, gluten, and soy.

  • The Customer is responsible for reviewing ingredient lists.

  • We do not guarantee that any meal kit is 100% free of trace allergens.

4. Delivery and Acceptance

  • Delivery is deemed complete when the package is left at the designated address.

  • The Customer must inspect the kit upon arrival. Any concerns regarding the integrity of the packaging or the temperature of the contents must be reported within 2 hours of delivery.

5. Limitation of Liability & Indemnity

Important Notice: To the maximum extent permitted by law, Van Wyk Vendors, its owners, and employees shall not be held liable for any direct, indirect, incidental, or consequential damages.

  • Assumption of Risk: The Customer acknowledges that handling raw food and reheating cooked meals carries inherent risks, including foodborne illness.

  • No Responsibility for Loss or Death: Van Wyk Vendors expressly disclaims all liability for any personal injury, illness, permanent disability, or death arising from the consumption, handling, or preparation of our products.

  • Property Loss: We take no responsibility for any loss of property or financial loss resulting from delivery failures or product spoilage.

6. Governing Law

These terms are governed by the laws of the jurisdiction in which Van Wyk Vendors operates. If any part of these terms is found to be unenforceable, the remainder shall remain in full effect.

7. Refund and Cancellation Policy

Due to the perishable nature of our raw and cooked meal kits, Van Wyk Vendors adheres to a strict policy regarding cancellations and returns to maintain food safety standards.

  • Order Cancellations:

    • Cancellations must be made at least 24 hours prior to the scheduled dispatch time.

    • Orders cancelled within the 24-hour window are subject to a 50% cancellation fee to cover the cost of ingredients already prepared or sourced.

    • Once an order has been dispatched for delivery, no cancellations or refunds will be permitted.

  • Returns: * For health and safety reasons, we cannot accept returns of food items once they have left our control. Even if the packaging is unopened, the integrity of the cold chain cannot be guaranteed once in the customer's possession.

  • Refunds and Credits:

    • Refunds will only be considered in the event of a proven clerical error (e.g., incorrect items delivered) or a documented failure of our delivery service (e.g., package not delivered).

    • If a product is deemed unfit for consumption at the exact moment of delivery, the Customer must provide photographic evidence of the damage or temperature deviation within 2 hours.

    • Approved refunds will be processed via the original payment method or issued as a store credit at the discretion of Van Wyk Vendors.

  • Missed Deliveries:

    • If a delivery is unsuccessful because the Customer was unavailable or provided an incorrect address, the kit will be left at the delivery point at the Customer’s risk. No refunds will be issued for spoiled food resulting from missed deliveries.

8. Acceptance of Terms

Payment for any order constitutes a formal acceptance of these Terms and Conditions, including the Refund and Cancellation Policy and the Limitation of Liability.
